Terms of Service

Please read these Terms of Service ("Terms") carefully before using the BoardingKit application (the "App"), operated by Arc Digital LLC ("Arc Digital," "we," "us," or "our"). By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

The App is a tool for businesses and is intended for users 18 and older. By using the App and making any purchase, you confirm that you are at least 18, that you can form a binding agreement, and that any purchase is made through your own Apple ID.

2. License

Arc Digital grants you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, to manage your own dog boarding or daycare operation. You may not copy, modify, reverse-engineer, resell, sublicense, or redistribute the App except as permitted by law.

3. Subscription and billing

BoardingKit is a subscription app. An auto-renewable subscription, billed monthly or annually, is required to add or change records — creating or editing clients, pets, bookings, vaccination records, and boarding agreements. Subscription pricing is shown in the App and the App Store before you subscribe.

If you have not previously used it, a 1-month free trial may be offered through the App Store. The trial converts to a paid subscription at the end of the month unless you turn off auto-renew at least 24 hours before it ends. Any unused portion of a free trial is forfeited when you purchase a subscription.

The subscription is sold through the Apple App Store and billed to your Apple ID. It renews automatically at the then-current price for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription, and turn off auto-renew, in your App Store account settings. Arc Digital does not process payments directly. Purchases can be restored on your other devices using the same Apple ID through "Restore Purchase" in the App. All refund requests are handled by Apple under Apple's policies; Arc Digital cannot issue refunds for App Store purchases.

If your subscription lapses, the App becomes read-only. Every record you have already created remains visible, and you can still export your income data, check pets in and out of stays already booked, and archive or restore records. Adding new records, and changing the details of existing ones, requires an active subscription. You can resubscribe at any time from Settings.

4. Acceptable use

You agree to use the App lawfully and not to: violate any applicable law; attempt to gain unauthorized access to the App or interfere with its operation; reverse-engineer or tamper with the App; or use automated means to copy, scrape, or interfere with the App, except to export or manage your own data where the App allows it. You are responsible for the data you enter and for maintaining your own device and iCloud security.

5. An organizational tool, not professional advice

BoardingKit is an organizational tool for scheduling bookings and keeping records and reminders. It does not provide veterinary, legal, tax, or business advice, and it is not a substitute for professional judgment. Reminders, schedules, capacity, and any information shown are aids only and may be incomplete, delayed, or inaccurate. You are solely responsible for the animals in your care, for your business decisions, and for meeting any licensing, insurance, zoning, and other legal requirements that apply to operating a boarding or daycare business where you are. Always consult a qualified veterinarian for any animal's health, and never rely on the App in an emergency.

6. Your data and your clients

Your use of the App is also governed by our Privacy Policy, incorporated here by reference. Your data is stored on your device and synced through your private iCloud; Arc Digital does not collect or have access to the app records you enter. You retain full ownership of everything you enter, and you can edit or archive it at any time within the App. Because the App stores information about your own clients and their pets, you are responsible for handling that information appropriately and for any notice or consent your local laws require.

7. Intellectual property

The App and its original content, features, design, and functionality are and remain the property of Arc Digital LLC. "BoardingKit," our logo, and related marks are trademarks of Arc Digital LLC and may not be used without our prior written consent. You retain ownership of the data you enter.

8. Third-party services

The App relies on Apple (iCloud sync and App Store purchases) and RevenueCat (subscription management). Your use of these is subject to their respective terms and privacy policies, and we are not responsible for their practices. Apple's terms are at apple.com/legal/internet-services/itunes. Your license to download and use the App itself is also governed by Apple's standard Licensed Application End User License Agreement, at apple.com/legal/internet-services/itunes/dev/stdeula.

9. Disclaimer of warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT REMINDERS WILL ALWAYS BE DELIVERED.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ARC DIGITAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY HARM TO AN ANIMAL OR LOSS TO YOUR BUSINESS ARISING FROM RELIANCE ON THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $20 USD.

11. Indemnification

You agree to defend, indemnify, and hold harmless Arc Digital LLC and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the App or your violation of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Missouri, and you consent to personal jurisdiction there.

13. Changes to these Terms

We may modify these Terms from time to time. We will update the effective date and note material changes in the App. Continued use after a revision takes effect constitutes acceptance.

14. Termination

These Terms remain in effect while you use the App. You may stop using the App at any time, and you may cancel your subscription through the App Store. Sections 5, 6, 7, 9, 10, 11, and 12 survive termination.
